Managed by the U.S. Citizenship and Immigration Services (USCIS), the EB-5 Program, also referred to as the Immigrant Investor Program, enables eligible foreign investors to gain permanent residency by fulfilling specific capital investment and job creation criteria, thereby contributing to U.S. communities.

Established by Congress in 1990, the EB-5 Program aims to enhance the U.S. economy by attracting investments from qualified foreign investors.

What You Need to Know:

Minimum Investments: The minimum investment amount has been raised to $1.8 million while the minimum for Targeted Employment Areas (TEAs) is $900,000. Adjustments for inflation will occur every five years going forward.

Application Process

To apply for an EB-5 visa, submit either Form I-526 (for standalone investors) or Form I-526E (for regional center investors)

Once your petition is approved, you can either:

1. Submit DS-260 to obtain an EB-5 visa abroad and enter the U.S., or
2. File Form I-485 if you haven’t done so already to adjust your status to a conditional permanent resident in the U.S. Upon approval, conditional permanent residence is granted for two years.

Before the second anniversary of your status adjustment or admission, file Form I-829 to remove conditions on your permanent resident status. If approved, conditions will be lifted for you and any included dependents.
